A power of attorney, simply put, allows another to manage our affairs on our behalf. It can be a simple power of attorney to deal with whilst someone is abroad or a continuing welfare power of attorney which allows the attorney to act even after the loss of legal capacity. It is not only in old age that a power of attorney is recommended – at any stage in life a misfortune can strike you leaving you unable to administer your estate – that is when a power of attorney can be required. In some instances unless a suitable power of attorney has been signed it might be necessary to apply to the Court for the appointing of a guardian. The appointment of a guardian can be very expensive and greatly exceeds the cost of the granting of a power of attorney.
